As opening statements begin today in the long-awaited Tupac Shakur murder trial, one of the most anticipated witnesses won’t be in the courtroom. Former Death Row Records CEO Marion “Suge” Knight — the only living eyewitness to the 1996 drive‑by shooting that killed the rap legend — has been granted an emergency leave of absence due to health concerns, according to court officials .

Knight, 61, is currently serving a 28‑year prison sentence in California for a 2015 fatal hit‑and‑run . He was scheduled to be transported to Las Vegas to testify in the trial of Duane “Keffe D” Davis, 63, the former South Side Compton Crips leader charged with orchestrating Shakur’s murder.

Health Concerns Take Priority

Knight’s attorneys filed an emergency motion citing “significant medical issues” that prevent him from traveling and participating in the trial proceedings . Court officials confirmed the request was granted, though they did not specify the nature of Knight’s health issues .

The decision comes despite Knight being listed as a key witness on the prosecution’s 200‑person witness list . As the driver of the black BMW in which Shakur was shot on September 7, 1996, Knight is the only surviving person who was in the vehicle when the gunman opened fire .

Knight’s Refusal to Testify

Even before his health issues emerged, Knight had made it clear he wants nothing to do with the trial. In an interview with ABC News last week, he stated emphatically:

“This trial has nothing to do with me and if somebody brings me there, it’s gonna hurt whoever brings me there. I promise you that.”

Knight warned both the prosecution and the defense against calling him to the stand:

“They make me come there against my will, if Keffe D’s lawyers bring me there, it don’t look good for him. If the prosecution brings me there, it don’t look good for them. Leave me out of it.”

The Code of Silence

Knight’s refusal to testify is rooted in his longstanding refusal to cooperate with law enforcement — a position he has maintained for nearly three decades . He elaborated on why he won’t testify against Davis:

“To actually get on the stand, and point somebody out, it’s worse than taking a gun and shooting that man in the head. Because if you shoot a person in the head, they die once. If you get on the stand and you snitch on that person, they die a million times.”

“I am not going to be responsible for sending another man to prison for the rest of his life. If God’s forgiving, who am I to think I’m bigger than God and don’t forgive?”

The Trial Proceeds

Despite Knight’s absence, the trial of Duane Davis is proceeding today with opening statements scheduled before Clark County District Court Judge Carli Kierny . Davis has pleaded not guilty to one count of murder with a deadly weapon with the intent to promote, further, or assist a criminal gang .

Davis is not accused of pulling the trigger. Prosecutors allege he orchestrated the attack and was in a white Cadillac with three other individuals during the drive‑by shooting . They will rely heavily on Davis’s own words — including his 2008 police interviews and his 2019 memoir, “Compton Street Legend,” in which he detailed his alleged role .
