U.S. District Judge Susan Illston issued the opinion late Friday, writing that top Homeland Security officials directed FEMA’s leadership to submit a staffing plan with the 50% cut — even though the agency’s own supervisors objected .

The Ruling: A Violation of Post-Katrina Protections

Illston wrote that the government violated rules established after Hurricane Katrina in 2005 that put staffing decisions squarely in FEMA’s hands — not the Department of Homeland Security’s — and prevented DHS from “substantially” reducing FEMA’s functions .

The judge didn’t order a specific remedy but directed both sides to meet and decide on a course of relief .

The Signal Message Scandal

In a separate filing, Illston criticized the use of Signal — a secure messaging app with auto-delete features — by former acting FEMA head Karen Evans and former DHS deputy chief of staff Joseph Guy .

Evans created a Signal chat that “would appear to be highly relevant to this case,” with messages set to auto-delete after four weeks. After she was named a defendant in the lawsuit, she shortened the auto-delete timer. Evans created a backup of her Signal messages in April 2026, “by which point the most timely messages were long since deleted,” Illston wrote .

The court found Evans’ actions were intentional.

The judge barred the administration from relying on any previous testimony denying plans to reduce FEMA staffing, and said the court will presume the lost Signal messages “would have been unfavorable to Defendants” .

The Human Cost: 4,300 Employees Gone

The ruling comes after more than 4,300 employees — about 17% of FEMA’s workforce — separated from the agency in the 2025 budget year. Over 1,500 left through voluntary reductions .

In August, the Government Accountability Office found that the departures resulted in “loss of institutional knowledge and experienced personnel” and “exacerbated longstanding workforce challenges” .

The GAO recommended that Congress “consider requiring” FEMA to base significant workforce decisions on a more strategic planning process. Without it, the GAO found, “FEMA cannot be assured that the agency is positioned to effectively meet its mission needs” .

Why It Matters to Urban Communities

FEMA is the federal agency responsible for disaster response and recovery — from hurricanes to wildfires to floods. When its staffing is cut, the first federal boots on the ground are fewer. Aid distribution slows. Long-term recovery funding gets delayed.
